General terms and conditions

General terms and conditions for processing services for digital twin creation and usage.

These general terms and conditions of business (hereinafter: “General Terms”) govern access to the You2You d.o.o. Beograd-Stari grad application (hereinafter: “Application”) and its use and are binding between you as a user and the company You2You d.o.o. Beograd-Stari grad with its registered office at Žorža Klemansoa 8, sprat 2, stan 5, 11000 Belgrade, Serbia, registered under registration number 22189786 (hereinafter: “You2You”).

  1. 1. Scope of Services:

1.1. You2You, a limited liability company based in Serbia, agrees to act as a processor for digital twin creation on behalf of the individual Clients.

1.2. Participants agree to refer to the You2You in case of any queries related to the digital twin, and the You2You’s representation is limited to the digital twin creation and maintenance.

1.3. Clients hereby agree to provide You2You with any additional information and/or documents if required so by local authorities. In case Clients fail to provide such additional information/documents, You2You might be required to remove the affected Client from You2You platform and block the related You2You account.

  1. 2. Data Protection:

2.1. The You2You and Clients agree to comply with the Serbian Data Protection Law and General Data Protection Regulation (together “GDPR”) and will handle personal data in accordance with the GDPR principles.

2.2. Personal data collected during the registration and digital twin creation will only be used for the purpose of facilitating the digital twin creation, performance of these General Terms and will not be shared with third parties without explicit consent.

2.3. The You2You will implement appropriate technical and organizational measures to ensure the security and confidentiality of personal data.

2.4. Clients have the right to request access to their personal data, as well as to request that their personal data be corrected, deleted or restricted in processing. For a more complete understanding of the rights you have in relation to your data, please read our Privacy Policy, i.e. other notices related to the protection of personal data.

  1. 3. Liability:

3.1. The You2You shall not be liable for any loss, damage, or inconvenience arising from the actions of Clients.

3.2. The You2You’s liability is limited to the effective creation of digital twin on behalf of the Client.

 

  1. 4. Termination:

4.1. By accepting these General Terms, Clients accept that You2You is just an intermediate between Clients and digital twin.

  1. 5. Governing Law:

5.1.These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Serbia and/or Organizer’s local laws, if applicable.

  1. 6. Miscellaneous:

6.1. You2You reserves the right to change these General Terms at any time. Clients shall be duly notified on any such amendments in an appropriate manner. In case You2You is not able to contact individual Client due to lack of its contact its information, such Client shall be deemed as duly notified on changes to General Terms by making them publicly available on You2You’s website.

6.2. These General Terms constitute the entire agreement between the parties and supersede any prior discussions or agreements.

6.3. Should any dispute arise between You2You and Clients, the dispute will be resolved through negotiation. If the negotiations fail, the dispute will be resolved in accordance with the laws of Serbia and the competent court in Serbia.

6.4. All terms expressed in these General Terms are gender-neutral. In instances where pronouns or other linguistic elements are used, they shall be interpreted and applied in a manner that includes all genders. The intention is to promote inclusivity and equality, and the use of masculine, feminine, or gender-specific language is not indicative of bias or preference. You2You and Clients hereby acknowledge and agree to the use of language that is neutral with respect to gender. I confirm that I have read and understood these General Terms and that I agree to be bound by them when using the Application.

  1. 7. Age and Identity Restrictions:

7.1. Participants must be at least 18 years old to become a Client of You2You and be eligible to create their own digital twin.

Any violation of these requirements may result in removal from You2You platform and blocking of You2You account.

  1. 8. Use of Artificial Intelligence:

8.1. You2You uses artificial intelligence (AI) features to support educational experiences on the platform.

8.2. AI systems on You2You are designed as supportive tools only. They do not make binding decisions or replace human judgment. All final decisions related to digital twin, participation, and use of platform features remain under the control of the user or, where applicable, human administrators.

8.3. Use of AI features does not affect users’ legal rights and does not result in automated decision-making with legal or similarly significant effects.

8.4. AI and Automated Processing

8.5. You2You uses AI-supported features to enhance training and learning experiences. This may involve processing Client’s data, interaction data, and account-related information in order to generate personalized feedback and insights.

8.6 AI is used solely to support user experience. It does not perform automated decision-making that produces legal effects or similarly significant impacts on users.

You2You does not use AI to process biometric data or conduct surveillance. All personal data processing related to AI features is carried out in accordance with this Privacy Policy and applicable data protection laws.
